OFFICIAL RULES
Important: Please read these rules before entering
this contest (the "Contest").
By clicking on the
"Accept" button below and/or participating in the Contest,
you agree to be bound by these Official Rules and represent that you
satisfy all of the eligibility requirements set forth below.
NO PURCHASE IS NECESSARY TO ENTER THIS CONTEST.
1. Eligibility. PURCHASE WILL NOT INCREASE ODDS OF WINNING. CONTEST VOID WHERE PROHIBITED. CONTEST OPEN ONLY TO RESIDENTS OF WASHINGTON STATE WHO ARE AND HAVE BEEN RESIDENTIAL ELECTRIC CUSTOMERS OF PUGET SOUND ENERGY, INC. ("SPONSOR"), AND LIVED IN THE SAME DWELLING, SINCE AT LEAST OCTOBER 1, 2008, AND ARE AT LEAST EIGHTEEN (18) YEARS OF AGE. IF YOU DO NOT MEET ANY OF THESE REQUIREMENTS, OR ANY OTHER ELIGIBILITY REQUIREMENTS IN THESE OFFICIAL RULES, THEN SPONSOR RESERVES THE RIGHT NOT TO AWARD PRIZES TO YOU. To be eligible to win a prize, entries must be completed and received by Sponsor in the format designated below. Directors, officers, competitors and employees of Sponsor and any of their respective affiliates, subsidiaries, agents, professional advisors, agencies, and immediate families of each are not eligible to win any prizes. All applicable federal, state and local laws and regulations apply. Limit one (1) entry per household.
2. Disclaimer. Sponsor, all participating sponsors and any of their respective parent companies, subsidiaries, affiliates, directors, officers, professional advisors, employees and agencies (together, the "Released Parties") will not be responsible for: (a) any late, lost, misrouted, garbled or distorted or damaged transmissions or entries; (b) telephone, mechanical, electronic, hardware, software, network, Internet, or other electronic, mechanical, computer- or communications-related malfunctions or failures; (c) any Contest disruptions, injuries, losses or damages caused by events beyond the control of Sponsor or by non-authorized human intervention; or (d) any printing or typographical errors in any materials associated with the Contest.
3. Contest Period. The Contest starts at 12:01 A.M. (all times Pacific Time) on July 6, 2009 and ends at 11:59 P.M. on November 1, 2009 (the "Deadline"). All entries must be received by the Deadline to be eligible to win a prize.
4. Prizes. As discussed in more detail below in Section 6, entrants will receive points based on successful completion of certain activities before the Deadline. The sixty-eight (68) highest scoring (i.e., point-earning) entrants will receive prizes as follows:
- Grand Prize: One (1) highest scoring entrant will receive a $7,500 gift card for use at Lowe's Home Centers, Inc. ("Lowe's) or Ace Hardware Corporation ("Ace Hardware") stores (Sponsor's choice) and a home energy audit* from Sponsor or Sponsor's designated service provider (approximate retail value $95).
- Second Place Prizes: The next two (2) highest scoring entrants will each receive a $2,500 gift card to Lowe's or Ace Hardware (Sponsor's choice) and a home energy audit* from Sponsor or Sponsor's designated service provider (approximate retail value $95).
- Third Place Prizes: The next sixty-five (65) highest scoring entrants will each receive a $500 gift card to Lowe's or Ace Hardware (Sponsor's choice) (approximate retail value $500 each).
(Total approximate retail value of all prizes is $45,285.)
Important Exception: *Sponsor may, in its sole discretion, award a prize of equivalent value to any prizewinning renter in place of the home energy audit prize.
Odds of winning a prize depend on the number and quality of eligible entries received. ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE ANY PRIZES ARE THE SOLE RESPONSIBILITY OF THE WINNERS. All prizes will be awarded. Prizes returned as undeliverable or otherwise not claimed within ten (10) days after delivery of notification will be forfeited and awarded to an alternate winner. Prizes are not transferable. No substitutions or exchanges of any prizes will be permitted. Limit one (1) prize per household or address.
In the event of a dispute about the identity of the entrant, entries made online will be declared made by the authorized account holder of the e-mail address submitted at time of entry. An authorized account holder is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g. business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. The potential winner may be required to provide Sponsor with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry.
5. How to Enter. To enter online, visit www.rockthebulb.com, complete the online registration form for the Contest, and follow the directions to participate before the Deadline. Entrants may also enter offline by providing registration information to a Sponsor representative at any Contest Event (defined below). If you register at any Contest Event, a Sponsor representative will provide you directions for how to participate before the Deadline. Information required in online and offline registration forms includes your full name (as listed on your Puget Sound Energy, Inc. utility account), e-mail address, and mailing address. An entry into the Contest consists of your completed online/offline registration form and submitted activity verifications/codes (as applicable). Entries received by postal mail, facsimile or other means not expressly permitted in these Official Rules will not be considered. All text associated with entries must be written in English. All requested information must be provided for your entry to be valid. Entries submitted to Sponsor in connection with the Contest will not be returned to entrants.
6. How to Participate and Score Points. Entrants will receive points by successfully completing the Contest activities listed below (each a "Contest Activity") before the Deadline. Entrants may participate in and/or sign up for Contest Activities at the following Contest events (each a "Contest Event"):

Contest Activities: A list of Contest Activities follows:
- Bulb Exchange Activity: You will receive 50 points by providing a Sponsor representative with between one (1) and ten (10) incandescent light bulbs; the Sponsor representative will then provide you with an equivalent number of compact fluorescent light bulbs (between one (1) and ten (10). Maximum points for this activity: 50.
- Visit 3 Stations Activity: You will receive 25 points by visiting all of the following three stations at any Contest Event, obtaining verifications on a lanyard (to be provided by Sponsor at each Contest Event) from a Sponsor representative at each such station, and submitting a completed lanyard to a Sponsor representative at the Contest Event "checkout" station. The names of three stations for this activity follow: "Battle of the Bulbs" station, "Name that Bulb" station, and "Which Bulb is an Energy (Rock) Star" station. Maximum points for this activity: 25.
- Visit the Sponsor "HomePrint" Booth. You will receive 25 points by visiting the Sponsor "HomePrint" booth located at each Contest Event and speaking with a Sponsor energy adviser and/or attending a 15-minute class about energy conservation. Maximum points for this activity: 25.
- Take the ENERGY STAR Pledge. You will receive 5 points by taking the ENERGY STAR pledge and confirming your pledge online www.rockthebulb.com or offline by visiting with a Sponsor representative at any Contest Event. Maximum points for this activity: 5.
- Volunteer with Project Porchlight. You will receive 30 points by volunteering with Sponsor partner Project Porchlight to hand out free energy-saving bulbs in your community, either door-to-door or at a Project Porchlight-designated community event. Project Porchlight will provide bulbs, training, and information for volunteers. Sign up to volunteer at www.projectporchlight.com. Maximum points for this activity: 30.
- Recruit Friends and Family to Join the Contest. You will receive 5 points for each eligible friend or family entrant you successfully sign up for the Contest. (Each such friend or family entrant must reside at different addresses to qualify for multiple 5-point awards.) You will receive credit for each such entrant who enters the Contest (up to a maximum of 100 points), provided each such entrant clicks a Sponsor-provided link in referral e-mails to complete his/her entry form. When participating in this activity, you must inform any potential friends and family entrants that you are contacting them so you can potentially earn points in a Puget Sound Energy contest.
- Minimize Electricity Consumption During the Month of October. Sponsor will compare each participating entrant's October 2009 electricity consumption with his/her October 2008 electricity consumption and calculate each such entrant's percentage decrease ("Savings") in October 2009 electricity consumption. Sponsor will then group entrants into the following tiers based on their Savings:
- Tier 1: Those entrants with the top 10% Savings will each receive 100 points.
- Tier 2: Those entrants with the next highest 10% Savings (i.e., less than the top 10% Savings, but equal to or greater than the top 20% Savings) will each receive 80 points.
- Tier 3: Those entrants with the next highest 10% Savings (i.e., less than the top 20% Savings, but equal to or greater than the top 30% Savings) will each receive 60 points.
- Tier 4: Those entrants with the next highest 10% Savings (i.e., less than the top 30% Savings, but equal to or greater than the top 40% Savings) will each receive 40 points.
- Tier 5: Those entrants whose Savings do not fall under Tiers 1-4 above, will each receive 20 points.
Sponsor will determine monthly electricity consumption on a pro rata basis based on its (or its agents' or approved service providers') meter readings for the applicable months.
7. Determination of Winners. Qualified Sponsor designated judges will determine, in their sole discretion, whether and what points are awarded in connection with the Contest Activities. On or about November 15, 2009, Sponsor will calculate the total number of points earned by each qualified entrant to determine the sixty-eight (68) winning entries. In the unlikely event of a tie, the winners will be determined by the highest score in the following category: The largest percentage decrease in October 2009 electricity consumption (as compared with October 2008). Sponsor will notify the sixty-eight (68) winners by e-mail and/or direct mail using the information provided in the online registration form on or about November 30, 2009. To claim a prize, each winner must follow the instructions contained in his/her notification.
8. General Release. By entering the Contest, you release Sponsor and all Released Parties from any liability whatsoever, and waive any and all causes of action, related to any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Contest or delivery, misdelivery, acceptance, possession, use of or inability to use any prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, data errors, data loss, data impairment, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory.
9. Use of Winner Name, Likeness, etc. Except where prohibited by law, entry into the Contest constitutes permission to use each winner's name, address, likeness and/or prize information, without limitation, for promotional purposes without further permission or compensation. As a condition of being awarded any prize, except where prohibited by law, winners may be required to execute an additional written consent to the use of their name, address, likeness and/or prize information, without limitation, for promotional purposes without further permission or compensation.
10. Affidavit & Release. As a condition of being awarded any prize, winners will be required to execute and deliver to Sponsor a signed affidavit of eligibility and acceptance of these Official Rules and release of liability, and any other required legal, regulatory or tax-related documents required by Sponsor in its sole discretion.
11. Winner List; Rules Request. For a copy of the winner list, send a stamped, self-addressed, business-size envelope after December 15, 2009 and before December 16, 2010 to Sponsor at the address listed below, Attn: PSE "Be an Energy Rock Star" Contest Winner List. 13. LIMITATION OF LIABILITY. IN NO EVENT WILL THE RELEASED PARTIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM YOUR PARTICIPATION IN THIS CONTEST, EVEN IF SPONSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. WITHOUT LIMITING THE FOREGOING, EVERYTHING PROVIDED FOR THE CONTEST, INCLUDING WITHOUT LIMITATION IN CONNECTION WITH ANY CONTEST ACTIVITY, IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. ANY OF THE ABOVE LIMITATIONS OR EXCLUSIONS THAT ARE PROHIBITED BY LAW SHALL NOT APPLY TO SUCH CONTESTANT.
14. Miscellaneous. The Contest and these Official Rules will be governed, construed and interpreted under the laws of the State of Washington. Entrants agree to be bound by these Official Rules and by the decisions of Sponsor, which are final and binding in all respects. Sponsor reserves the right to change these Official Rules at any time, in its sole discretion, and to suspend, cancel, postpone or extend the Contest or any entrant's participation in the Contest should viruses, bugs, unauthorized human intervention or other causes beyond Sponsor's control affect the administration, security or proper play of the Contest or Sponsor otherwise becomes (as determined in its sole discretion) incapable of running the Contest as planned. Entrants who violate these Official Rules, tamper with the operation of the Contest or engage in any conduct that is detrimental or unfair to Sponsor, the Contest or any other entrant (in each case as determined in Sponsor's sole discretion) are subject to disqualification from entry into the Contest. Sponsor reserves the right to lock out persons whose eligibility is in question or who have been disqualified or are otherwise ineligible to enter the Contest. Prizes will be awarded as follows: Up to two (2) winners will each receive a gift card for $250 for use at Lowe's Home Centers, Inc. and a home energy audit* from Sponsor or Sponsor's designated service provider (approximate retail value $95). (Total approximate retail value of all prizes is $690.)
Important Exception: *Sponsor may, in its sole discretion, award a prize of equivalent value to any prizewinning renter in place of the home energy audit prize.

5. How to Participate; Determination of Winners. Sponsor will place two (2) winning "Green Bulbs" at the Auburn Lowe’s store (located at 1232 A Street NE, Auburn, WA, 98002) in connection with Sponsor's "Rock the Bulb" Tour Unplugged Event to be held at Lowe's store from 10:00 A.M. to 4:00 P.M. on Saturday, October 10 and Sunday, October 11, 2009. At least twice each day on October 8, 2009 until all Green Bulbs are found and returned, Sponsor will post clues online at www.rockthebulb.com and www.twitter.com/PSErockthebulb concerning the location of the Green Bulbs. Participants must follow these online clues to find the Green Bulbs. In order to win, a participant must find a Green Bulb, and submit his/her full name, e-mail address, mailing address, phone number, and Green Bulb to the Green Bulb Redemption Officer attending the "Rock the Bulb" event before the Deadline. Sponsor will notify each winner in person at the "Rock the Bulb" event. To claim a prize, each winner must follow the instructions contained in his/her notification.
6. General Release. By entering the Contest, you release Sponsor and all Released Parties from any liability whatsoever, and waive any and all causes of action, related to any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Contest or delivery, misdelivery, acceptance, possession, use of or inability to use any prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory.

ANY OF THE ABOVE LIMITATIONS OR EXCLUSIONS THAT ARE PROHIBITED BY LAW IN A PARTICULAR ENTRANT’S JURISDICTION SHALL NOT APPLY TO SUCH CONTESTANT.
